FORT WAYNE, Ind. (WKRC) - An Indiana judge recently ruled that tacos are "Mexican-style sandwiches."
According to WANE, Judge Craig Bobay ruled that "tacos and burritos are Mexican-style sandwiches," ending a years-long battle between a restauranteur and the Allen County Plan Commission in Fort Wayne, Indiana. Per the station, Judge Bobay's ruling has opened the door for Famous Taco to open a second location at a strip mall in the city's southwest side.
“The Court agrees with Quintana that tacos and burritos are Mexican-style sandwiches, and the original Written Commitment does not restrict potential restaurants to only American cuisine-style sandwiches,” Judge Bobay wrote, per the station.
The outlet reported the commission had rejected Famous Taco from opening in the strip mall due to a "written commitment," the restaurateur signed. The commitment stated that any restaurant at the strip mall had to adhere to the following conditions:
- Does not offer alcohol
- Does not allow outdoor seating
- Only sold "made-to-order or Subway-style sandwiches"
Those conditions were meant to keep "traditional fast food restaurants such as McDonald's, Arby's and Wendy's" from filling locations, according to UPI.
"The proposed Famous Taco restaurant would serve made-to-order tacos, burritos and other Mexican-style food, and would not have outdoor seating, drive through service or serve alcohol. The Court agrees with Quintana that tacos and burritos are Mexican style sandwiches, and the original Written Commitment does not restrict potential restaurants to only American cuisine-style sandwiches," Judge Bobay wrote, per the outlet.
The judge added that the original agreement would also apply to made-to-order restaurants offering Greek gyros, Indian naan wraps or Vietnamese Banh mi, per UPI.
